These terms are an agreement between you and BeezGuard (“BeezGuard”, “we”, “us”) for using the BeezGuard app and website (the “Service”). By using the Service, you agree to these terms. If you don't agree, please don't use it.
1. Using the Service
- You must be at least 13 years old to use BeezGuard.
- You're responsible for keeping your account details secure and for activity on your account.
- Give accurate information when you create an account.
2. Detection results are a guide, not a diagnosis
BeezGuard uses machine learning to detect varroa mites, honey bees, wasps, hornets, beetles, and queen, worker and drone bees. Results depend on image quality and conditions and may be incomplete or wrong. They are provided to help you monitor your hives and are not a substitute for a physical hive inspection, a mite count method such as an alcohol wash or sugar roll, or advice from a qualified bee inspector or veterinarian.
You are responsible for decisions you make about your colonies, including mite treatments and pest control. Always follow product labels and local regulations.
3. Your content
You keep ownership of the photos, videos and notes you add (“your content”). You give us permission to store and process your content only to provide the Service to you, as described in our privacy policy. You confirm you have the right to upload the content you add.
4. Acceptable use
You agree not to:
- upload content that is illegal, harmful or that you don't have the rights to
- try to break, overload, reverse engineer or copy the app or its models
- access the Service using bots or scrapers, or interfere with other users
- use the Service for anything unlawful
5. Our intellectual property
The app, website, models, design and the BeezGuard name and logo belong to BeezGuard. We give you a personal, non-transferable licence to use the app on devices you own or control, under these terms and Google Play's terms.
6. Changes and availability
We may update, change or discontinue features at any time. We try to keep the Service running but can't promise it will always be available or error-free.
7. Ending your use
You can stop using the Service and delete your account at any time. We may suspend or close accounts that break these terms.
8. Disclaimer
The Service is provided “as is” and “as available”, without warranties of any kind, including accuracy of detections, fitness for a particular purpose and non-infringement, to the extent the law allows.
9. Limitation of liability
To the extent the law allows, BeezGuard is not liable for indirect, incidental or consequential damages, including loss of colonies, honey, bees or income, arising from your use of the Service or reliance on detection results. Our total liability is limited to the amount you paid us in the 12 months before the claim, or US$50 if you paid nothing.
10. Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Disputes will be handled in the state or federal courts in Sacramento County, California, unless the law where you live gives you a different right.
11. Changes to these terms
We may update these terms. We'll change the date above and notify you of significant changes. If you keep using the Service after changes take effect, you accept the new terms.
